A Korean-licensed attorney at Han Kyeongjae Law Office. The attorney reviews every case personally, from the debtor check to the final letter, and signs every letter sent.
Your files are stored in a private, encrypted store in Seoul. Only the law office, and our technical operator for maintenance, can open them. If we do not take your case, we delete them 12 months after our last contact. If we do, they are kept under attorney confidentiality for as long as Korean law requires.
Often not. In Korea, most business claims expire after 5 years, and some, such as the price of goods sold, after 3 years. Other civil claims run for 10 years. A demand letter protects the claim for only 6 months unless court action follows. Send it early and we will confirm the deadline in the debtor check.
Partly. If we win in court, the debtor is ordered to pay court costs, including part of the attorney fees on a scale set by the Supreme Court. You can also claim late-payment interest: usually 6% a year on commercial debts, and 12% a year once a lawsuit is served. Fees for the demand letter stage are recoverable only if your contract allows it.
The debtor pays into the law office’s account in Korea. We deduct the agreed success fee and any court costs you approved, then send the rest to your bank by international transfer within 10 business days, with a statement. Bank transfer charges are deducted from the amount sent.
No. The $250 debtor check, the success fee and, if you approve court action, a quoted retainer and court fees at cost. Fees exclude VAT, which applies only in some cases. Clients outside Korea are generally zero-rated. Nothing else.
Yes, after any step. Work already started is not refundable. Court action never starts without your written approval.
